PARANORMAL TV PARTICIPANT REQUIREMENTS AND RELEASE Requirements: 1. You must be at least 18 years of age. 2. You must not be a candidate for public office and must agree not to become one until at least one year after the initial broadcast of the program in which you appear, if selected as a participant. 3. You must never have been convicted of a felony or misdemeanor, other than a minor traffic violation, and have never had a restraining order or other injunctive relief entered against you. There must not be any outstanding criminal warrants for you. 4. You must be a U.S. citizen. Release: For good and valuable consideration, receipt and sufficiency of which are hereby acknowledged, I hereby irrevocably grant Comcast Programming Development, Inc. and its related and affiliated entities, successors, assigns and licensees and their respective employees, agents, officers, directors and designees (collectively, “Comcast”) the right to record, distribute, exhibit and/or use or authorize others to use my name, voice, likeness, image and biographical information (collectively, “Likeness”) on or in any medium throughout the world in perpetuity for any purpose, including, without limitation, for the programming service currently entitled Paranormal (the “Service”) and for any other factual or fictional programs or productions. I hereby represent, warrant and covenant that: (i) I agree to and satisfy the Requirements listed above; (ii) all the statements I have made herein or otherwise to Comcast and/or make on any recording of my Likeness, whether or not created and/or submitted by me (the “Recordings”) are true, correct and complete, and I will immediately inform Comcast in writing if any of them becomes false, incomplete or inaccurate; (iii) I knowingly and voluntarily assume all risks associated with my participating in the Recordings; (iv) I will not violate any rights or applicable laws, rules, regulations or orders, engage in any cruelty or harm to people or animals, or cause any injury or damage to, any animal, party or any party’s property; (v) I will not be entitled to any consideration as a result of the exercise of the rights granted herein or in connection with the Recordings, the Service, the Works (as defined below) or the use or promotion thereof; (vi) any content or material that I use in connection with the Recordings, including without limitation, any likeness, music or artwork will be original (the “Works”), and I have the rights necessary to grant the rights granted hereunder to Comcast in the Works; and (vii) Comcast may rely upon this Release in producing, distributing and/or exploiting the Recordings, the Service, the Works and any portion thereof. I acknowledge and agree that Comcast shall have no obligation to use my Likeness, the Works or the Recordings or to include the same in any program or production, and all decisions by Comcast concerning the Recordings are final and not subject to challenge or appeal. I hereby grant a perpetual, irrevocable royalty-free license to Comcast to use the Works on or in any medium throughout the world in connection with the Recordings, including, without limitation, for the purposes of video and audio exhibition and distribution. I hereby acknowledge and agree that the Recordings and all right, title and interest therein are the sole property of Comcast, Comcast may alter, digitize, cut, edit and otherwise modify the Recordings, including, without limitation, to dub and/or replace any music and/or other soundtrack, in Comcast’s sole discretion, and Comcast has no obligation to return any Recordings or other materials to me. To the extent that I have any right, title or interest in the Recordings, I hereby irrevocably assign such right, title or interest to Comcast. I hereby release and indemnify Comcast and anyone using the Recordings, the Works or the Service from any and all claims, damages, liabilities, costs and expenses in connection with any breach of the representations, warranties or covenants hereunder, the Works, the Recordings, any releases and any exercise of the rights granted hereunder. I hereby irrevocably waive any right to inspect or approve any Recordings and/or the Service or any other materials and any droit moral, moral rights or similar rights or privileges. I shall not be entitled to terminate or rescind this Release nor to enjoin, restrain or otherwise impair Comcast’s exercise of any of the rights and privileges granted to Comcast hereunder, nor to restrain, enjoin or otherwise impair Comcast’s property or assets or the development, production, exhibition and/or exploitation of the Recordings, the Works, the Service or any portion thereof or any other program(s) incorporating the Recordings, the Service or any advertising, publicity or promotion in connection therewith. I have the full right and legal capacity to sign this Release and grant the rights and releases herein. I have read this Release prior to clicking “I ACCEPT,” and I understand and agree to its contents.
